1. Personal Data (Privacy) Ordinance

We will comply with the requirements set out in the Personal Data (Privacy) Ordinance (Cap. 486 of the Laws of the Hong Kong Special Administrative Region) (the “Ordinance”) in relation to the collection, use, storage, retention, disclosure, transfer, provision, access, protection and access of your information.

2. Collection of data and information
  • 2.1 When you use the Company’s App and/or related websites and/or participate in the membership program and/or submit an order and/or submit an application or request to us and/or submit information to us in any of the ways mentioned above, we may collect information from you, including but not limited to your name, address and/or delivery address, JoyYou card number, photo and/or image, telephone/mobile number, month of birth, gender, payment information (if you order our products or services, including electronic payment and/ or credit card and/or bank account numbers), email address, region, information relating to the social media account used to log in to the Member’s account, Internet Protocol (IP) address, type of operating system, browser type, domain name, log-in time and other information of other persons in connection with your request for information or services, and for the following purposes: (a) for identity verification and record purposes in connection with recruitment, provision of products and services and/or customer service; (b) to fulfil your request for our products or services and to process orders, payments and any billing payments; (c) maintaining correspondence and contact information in our internal database; (d) compiling statistics on the usage of the Company’s App and/or related websites; (e) responding to and handling any enquiries or fulfilling your requests; (f) evaluating and improving our products and services; (g) conducting direct marketing and/or market research, research or analysis in relation to our customers, products, services, activities, promotions or programmes, or (h) administering, operating, participating in or interacting with, partnering or co-operating in relation to the Membership Programme and/or Customer Loyalty Programme, including but not limited to Membership Programme Information and Membership Programme Benefits.
  • 2.2 You acknowledge and agree that the information you provide is voluntary.
  • 2.3 You may request access to, update, change or delete your data, your choices regarding the receipt of information and data from us or our use of your information by sending a data access/amendment/deletion request form (the “Request Form”) to our Customer Service Department by email info@pericles.com.hk or by post to our Customer Service Department, Room 1006, 10/F, Liberty Times Centre, 50 Hoi Yuen Road, Kwun Tong, Kowloon, Hong Kong. To the extent permitted by the Ordinance, the Company may charge a reasonable fee for the processing of the relevant request.
3. Use of Data in Direct Marketing
  • 3.1 We intend to use your data for direct marketing purposes by sending you direct marketing communications, such as mail, email, telephone or SMS containing news, offers and promotions in relation to food, beverages, catering products, services and loyalty programmes. We will not use your information for that purpose unless we have obtained your consent.
  • 3.2 We will not provide your information to any third parties for direct marketing purposes without your prior written consent.
  • 3.3 If you do not wish to receive any direct marketing materials from us, whether or not you have joined the Membership Programme or you have given your consent to us, you may send your request to our Customer Service Department via the Pericles App, the relevant website, instant messaging application (if you submit your information to us via this method) or by email to our Customer Service Department by email info@pericles.com.hk or by post to Room 1006, 10/F, Liberty Times Centre, 50 Hoi Yuen Road, Kwun Tong, Kowloon, Hong Kong, request us to cease using your data for direct marketing purposes. We will cease to use your data for direct marketing purposes within 1 month of receipt of your complete request.
4. Security

We will use reasonable security technologies and procedures to protect your information from unauthorised access, use or disclosure. However, due to the nature and technology of the Internet, it is still possible for others to intercept information you send to or through our App and/or related websites. We do not guarantee that the Company’s App and/or related websites will be free from hacking or attack.

5. Disclose, retain and store information

5.1 You acknowledge, agree and authorise us to retain and store the Data in one or more of our databases within or outside Hong Kong.
5.2 Unless with your prior consent or as permitted by law, we will not transfer, disclose, provide or provide access to your information to any third party, except as follows:

  • a) the Company and its subsidiaries;
  • b) our employees;
  • c) third-party payment platforms for payment transactions;
  • d) any person or entity to whom we are required to make disclosure under (i) applicable laws, court orders, administrative policies or regulations, guidelines or directions, (ii) orders given or issued by any regulatory, governmental, tax, law enforcement, other agencies, self-regulatory bodies or industry bodies in or outside Hong Kong, (iii) in connection with legal proceedings or (iv) establishing, exercising or defending legal rights in Hong Kong;
  • e) any person, entity or entity required to make disclosure for the purposes of conducting due diligence in connection with our business, merger, acquisition or transfer;
  • f) We are required to make disclosure to a person, organisation, individual or agency on the grounds that it endangers life or is an emergency and helps to identify an individual;
  • g) agents, contractors or third party service providers who provide operational, research, sales, data analysis and processing, computer technology, telecommunications, telemarketing, payment or other services for and in connection with the operation of our business, the provision of our products and/or services, the administration and operation of our membership programmes.

You acknowledge, agree and authorize us to transfer, disclose, provide or provide access to your information subject to the enforcement, implementation or compliance with any of the terms of our Terms and Conditions of Use or this Privacy Policy.

6. Access, Correction and Deletion of Data
  • 6.1 You have the right to enquire as to whether we hold data about you and to access any such data and, if necessary, to request that such data be corrected or updated. If you wish to access, correct or update your information, please send a request form to our Customer Service Department by email info@pericles.com.hk or by post to Customer Service Department, Room 1006, 10/F, Liberty Times Centre, 50 Yuen Yuen Road, Kwun Tong, Kowloon, Hong Kong. We will aim to respond to your complete request within 1 month, provided that we have received sufficient information to confirm your identity. To the extent permitted by the Ordinance, the Company may charge a reasonable fee for the processing of the relevant request. You may also update your name, gender, address and/or password under the Membership Programme through the Company’s App and/or related websites.
  • 6.2 If you wish to withdraw from the Membership Program and/or request the removal or deletion of your information, you may delete your membership account through the Company’s App, or send a request form to our Customer Service Department by email info@pericles.com.hk or by post to Customer Service Department, Room 1006, 10/F, Liberty Times Centre, 50 Kai Yuen Road, Kwun Tong, Kowloon, Hong Kong. We will remove or delete your data within 1 month of receiving your complete instructions or requests, provided that we have received sufficient information to confirm your identity.
7. Cookies

We may use cookies in connection with our App and/or related websites. Cookies are small pieces of information that are automatically stored on a computer’s web browser or device by a website or mobile application and can be retrieved by that website or mobile application. The information collected by cookies is anonymous aggregate research data and does not contain name or address information or any information that would enable anyone to contact you by phone, email or any other means. Most browsers are initially set to accept cookies. If you wish to stop cookies, you can change your browser settings. However, as certain features of the App and/or related websites require cookies to function, for example, if they are discontinued, these functions may not function properly, which may result in incorrect or complete display of some of our web pages.
